We view legal action to recover debt as the last option. However, when we consider that the legal process and court proceedings are in the best interests of our clients, we will advise accordingly.

Asseto provides a full range of legal services including :

• For individuals - from Notice of Proceedings, judgment through to Order of Examination hearings, Attachments or Bankruptcy
• For companies - from Statutory Demand through to Winding Up.

Legal services include the preparation, filing and service of legal documents to recover the debt through either the District Court (individuals) or the High Court (for companies). It also includes communication and negotiation with the defaulting customer (based upon client's instructions) and we attend the Court on behalf of clients. To support the legal process we have the support of our Field Service network to assist with the location of the debtor and serving of documents.  We can also prepare claims for the Disputes Tribunal and Tenancy Tribunal.

Asseto generally recommends taking legal action only if:

• The debtor has been given plenty of opportunity to pay and has failed to respond to ongoing demands for payment
• There is no dispute over the debt (disputes would need to be resolved first)
• The debtor's whereabouts are known
• There is an understanding that the debtor has the means to pay.

Quite often the simple act of commencing legal action sends a strong message to the debtor that you intend to enforce payment, even if you do not go to Court. It will frequently result in immediate payment or settlement of an outstanding account.  Our legal team can also help you establish or update your Terms of Trade (Refer to Other Services).

Our Legal team can discuss with you the most effective legal process to be used, either as part of our normal Debt Collection process or separately as part of your Collection process.
